New Game+ — Terms of Service

These Terms of Service ("Terms") are an agreement between you and New Game + LLC ("New Game+," "we," "us"), the operator of the New Game+ mobile application and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

The short version (not a substitute for the rest): be at least 13, own what you post but let us display it, don't abuse the service or other people, recommendations are AI-generated and can be wrong, subscriptions renew until you cancel in your app store settings, and disputes go to individual arbitration unless you opt out within 30 days.

1. Who can use New Game+

You must be at least 13 years old (or the higher minimum age of digital consent where you live). If you are under 18, you may use the Service only with permission from a parent or guardian. By using the Service you represent that you meet these requirements. We may refuse, suspend, or terminate accounts that violate these Terms.

2. Your account

You're responsible for your account and for keeping your credentials secure. Tell us promptly at support@newgameplus.gg if you believe your account has been compromised. You may delete your account at any time in the app (Profile → Delete account); deletion is immediate and irreversible.

3. License to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use, subject to these Terms and to the usage rules of the app store you downloaded it from. We retain all rights in the Service, including the app, its design, the recommendation engine, and our trademarks. These Terms don't give you any right to use the New Game+ name or branding.

4. Your content

"Your Content" means what you create in the Service: reviews, ratings, lists, bios, usernames, display names, editable taste summaries, and any other material you submit.

• You own it. You retain all rights in Your Content.
• You license it to us. So the Service can work, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content in connection with operating, promoting, and improving the Service, including showing it to other users (New Game+ is public by default — see the Privacy Policy). This license ends when you delete Your Content or your account, except where content has been shared with others and copied within the Service, or where we must retain it to comply with law.
• You're responsible for it. Post only what you have the right to post.

5. Acceptable use

Don't, and don't help anyone else:

• break the law, or post content that is unlawful, infringing, defamatory, or that harasses, threatens, or doxxes anyone;
• post sexually explicit content, content that sexualizes minors (zero tolerance — immediate termination and reporting to authorities), or content that promotes violence or self-harm;
• impersonate any person, misrepresent your affiliation, or squat usernames;
• spam, scrape, harvest data, or access the Service by any automated means outside our published interfaces;
• probe, overload, or attack the Service, circumvent rate limits or usage caps, or attempt to access other users' data;
• reverse engineer the app except where the law grants that right notwithstanding this term;
• resell or commercially exploit the Service without our written permission.

We may remove content or restrict accounts that violate this section, with or without notice, and preserve or disclose information as required by law.

6. Game data and third-party content

Game titles, cover art, artwork, and metadata are supplied by third parties (including IGDB/Twitch and, where you connect your Steam account, Valve) and belong to their respective rights holders. They're displayed for identification and informational purposes. New Game+ is not affiliated with or endorsed by any game publisher, Valve, Twitch, Apple, or Google. If you connect Steam, your use of Steam remains governed by Valve's terms.

7. AI-generated recommendations

New Game+ uses artificial intelligence (large language models and our own ranking systems) to generate recommendations, "why you'd like it" explanations, and taste summaries. This content is generated automatically, is based on the ratings and preferences you provide, and may be inaccurate, incomplete, or just wrong about a game or about your taste. It's provided for entertainment and informational purposes, is not professional advice of any kind, and isn't a guarantee you'll enjoy a game. Purchasing decisions are yours. Where you can edit AI-generated text about you (like your taste summary), the edited version is Your Content under §4.

8. New Game+ Premium (subscriptions)

Parts of the Service are free; some features require a paid subscription ("NG+"). Where offered:

• Auto-renewal. Subscriptions are billed through your Apple App Store or Google Play account and **renew automatically at the price and interval shown at purchase (for example, monthly or yearly) until you cancel.** The price, billing period, and renewal terms are displayed in the app and in the store's purchase sheet before you buy, and your purchase requires your affirmative confirmation through the store.
• How to cancel. Cancel anytime in your device's subscription settings (App Store: Settings → [your name] → Subscriptions; Google Play: Play Store → Profile → Payments & subscriptions). Cancellation takes effect at the end of the current billing period; you keep access until then. Deleting the app does not cancel a subscription.
• Price changes. If the price changes, the app store will notify you and, where required, ask for your consent before the new price applies. If you don't agree, cancel before the next renewal.
• Refunds are handled by the app store you purchased through, under their policies. We don't control store refund decisions.
• Free tiers and limits. Free usage caps (for example, weekly discovery queries) are part of the Service design and may change with notice.

9. Copyright complaints (DMCA)

We respect intellectual property rights and expect users to do the same.

• Takedown notices. If you believe content on the Service infringes your copyright, send a notice under 17 U.S.C. § 512(c)(3) to our designated agent: [AGENT NAME], [MAILING ADDRESS — use the Northwest registered-agent address], support@newgameplus.gg, [PHONE]. (This agent is registered with the U.S. Copyright Office's DMCA Designated Agent Directory.) Your notice must include: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner; and your physical or electronic signature.
• Counter-notices. If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice under 17 U.S.C. § 512(g)(3) to the same agent with: identification of the removed material and its prior location; a statement under penalty of perjury of good-faith belief the removal was mistaken; your name, address, phone number; consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., the U.S. District Court for the District of Arizona); and your signature. Unless the complainant files a court action, removed material may be restored in 10–14 business days.
• Repeat infringers. We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers, and we may remove content and suspend accounts on a first offense where warranted.

10. Termination

You can stop using the Service or delete your account at any time. We may suspend or terminate your access (with or without notice) if you violate these Terms, create risk or legal exposure for us or other users, or if we discontinue the Service. Sections that by their nature should survive (4, 6, 7, 11–16) survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. THIS INCLUDES AI-GENERATED CONTENT (§7) AND THIRD-PARTY GAME DATA (§6). SOME JURISDICTIONS DON'T ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US $50. SOME JURISDICTIONS DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any third-party right.

14. Dispute resolution — arbitration and class-action waiver

Please read this section carefully. It affects your rights.

• Informal resolution first. Before filing a claim, contact us at support@newgameplus.gg; we'll try to resolve the dispute informally within 60 days.
• Binding arbitration. Any dispute arising out of these Terms or the Service that isn't resolved informally will be settled by **binding individual arbitration** administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitrator decides all issues except that a court decides issues of arbitrability and the enforceability of the class-action waiver.
• Class-action waiver. **You and we each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding.** Claims may be brought only in an individual capacity. If the class-action waiver is found unenforceable for a particular claim, that claim (and only that claim) proceeds in court.
• Exceptions. Either party may bring an individual claim in small claims court, or seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.
• Costs. For claims under $10,000, we will pay arbitration filing, administration, and arbitrator fees beyond the amount of your court filing fee, unless the arbitrator finds the claim frivolous.
• 30-day opt-out. You may reject this arbitration agreement (keeping the rest of these Terms) by emailing support@newgameplus.gg within 30 days of first accepting these Terms, with your account email and a statement that you opt out of arbitration.

15. Governing law

These Terms are governed by the laws of the State of Arizona, excluding its conflict-of-laws rules, and the Federal Arbitration Act for §14. For disputes not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

16. App store terms

Your download is also governed by the store's terms (Apple Media Services Terms or Google Play Terms of Service). For iOS: these Terms are between you and us, not Apple; Apple has no obligation to furnish maintenance or support or handle any claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you. In case of conflict between these Terms and mandatory app store terms, the store terms control for the affected purchase.

17. Changes to these Terms

We may update these Terms as the Service evolves. For material changes we'll give notice in the app or by email at least 14 days before they take effect (except changes required by law, which may be immediate). Continuing to use the Service after the effective date means you accept the updated Terms. If you don't accept them, stop using the Service and delete your account.

18. Everything else

These Terms plus the Privacy Policy are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets with notice to you.
